LEGAL RIGHTS

Can workers be disciplined for publicly supporting unionization, signing an authorization card, or voting in the election? 

No.

Under the National Labor Relations Act, it is illegal for our employer to:

  • Question workers about union support at any stage in the process.
  • Fire, demote, or transfer an employee, or reduce hours, or threaten to do any of these actions because a worker supports forming a union.
  • Promise or grant promotions or pay raises to discourage staff from union support.
  • Threaten to close our workplace if workers choose to unionize.

Can my supervisor ask me if I support the union or not?

No. It is unlawful for supervisors and management to ask employees whether they support the union: it’s our decision.
